These terms govern the online sale of the PulseMyPortfolio Pro Licence. Use of the software itself is governed by the End-User Licence Agreement.

2. Subject

These Terms of Sale govern the online sale of the Pro Licence for the PulseMyPortfolio (PMP) software, which unlocks the application's Pro features. Use of the software is otherwise governed by the End-User Licence Agreement.

The PMP software is usable free of charge at its Standard tier; the purchase covers the unlocking of the Pro features only.

3. Price

  • Pro Licence: 59 € (one-time payment, perpetual licence, no subscription).
  • VAT not applicable, article 293 B of the French General Tax Code (small business VAT exemption). The price is therefore net of VAT.
  • The applicable price is the one displayed on the website at the time of the order.
  • AI costs are not included. PMP works on a bring your own key basis: AI analyses use your own API keys with the providers you choose; any consumption is billed by those providers directly, at their rates, and remains payable by you. The Pro Licence unlocks features; it provides neither AI credit nor AI access.

4. Order

Orders are placed online from the PMP website. The process includes at least: selection of the Pro Licence, a summary, express acceptance of these Terms of Sale, then payment. The sale is concluded on confirmation of payment. A summary is sent by email.

5. Payment

Payment is processed by Stripe, a secure payment provider, by bank card (and the means Stripe offers). WM STUDIOS has no access to your full card details. The order is only validated once payment has been authorised.

6. Delivery of the licence

The Pro Licence is digital content delivered electronically: a licence key (format PMP-XXXXX-XXXXX-XXXXX-XXXXX) is sent to the email address provided, immediately or as soon as possible after payment is confirmed. You activate that key under Settings → About → Pro Licence. The first activation requires an internet connection (verification of the key and registration of the device, up to 2 devices at a time, see EULA, art. 4); the application then works offline.

If you do not receive it, contact support; it will be re-sent after verification of payment.

7. Right of withdrawal and waiver

Under article L221-18 of the French Consumer Code, a consumer has fourteen days to withdraw.

However, for digital content supplied on an intangible medium whose performance begins immediately after purchase, article L221-28, 13° provides for the loss of the right of withdrawal where the consumer has (1) given express prior consent for performance (delivery of the key) to begin before the end of the fourteen day period, and (2) acknowledged that they thereby lose their right of withdrawal.

Accordingly, a dedicated tick box collects that twofold consent at the time of the order. Once the licence key has been delivered with that consent, the sale is firm and the right of withdrawal can no longer be exercised. See the Refund policy for cases of exceptional refund.

8. Statutory guarantees

Independently of any commercial warranty, a consumer buyer benefits from the mandatory statutory guarantees, which cannot be excluded: the statutory guarantee of conformity for digital content and services (French Consumer Code, art. L217-3 et seq.) and the guarantee against hidden defects (French Civil Code, art. 1641 et seq.). If the Pro Licence delivered does not work as described, the buyer may obtain its bringing into conformity or, failing that, a refund, on the terms provided by law. The « as is » statement in the EULA does not restrict those statutory guarantees.

9. After-sales service and support

Support is provided through the « Report a problem » button in the application and by email (support). It covers in particular problems with the delivery or activation of the Pro Licence.

10. Liability

The seller's liability applies on the terms and within the limits provided by the EULA and by law. No provision deprives a consumer of the rights they hold under mandatory provisions. It is recalled that PMP is a tracking and analysis tool, and neither investment advice nor tax advice (see EULA, art. 8).

11. Personal data

For the sale, only the necessary data is used (email address, payment data processed by Stripe), for the purposes of fulfilling the order and invoicing. The PMP application is local first: your data (holdings, wealth, analyses) stays on your device and no such data is collected on the publisher's servers. Activating a Pro licence is the only exception: it sends the key and a hashed device fingerprint, recorded on the Publisher's licence server (see the privacy policy). It is transmitted to third parties only when you explicitly trigger an action: AI analyses (to the provider you configure), prices and news (via Yahoo Finance), a bug report (your own mail client). 12. Complaints and consumer mediation

Any complaint is handled directly by WM STUDIOS, which seeks an amicable solution with the customer (support: see article 9).

Recourse to mediation requires that you have first sent a written complaint to our support and have not obtained a response that satisfies you. These details are also repeated in the order confirmation email.

13. Geographic availability and territorial exclusion

The Pro Licence is intended exclusively for persons located outside the United States of America. It is neither offered, nor sold, nor granted to persons located or resident in the United States of America, including its territories and possessions.

By placing an order, the buyer represents and warrants that they are not located or resident in the United States, that they are not accessing the service from that territory, and that they are not acting on behalf of a person located there.

WM STUDIOS implements reasonable measures intended to prevent sales into that territory (payment restrictions, withdrawal of the relevant markets on distribution platforms). WM STUDIOS reserves the right to refuse, block or cancel any order placed in breach of this article; where applicable the order is cancelled and refunded. This restriction is temporary and may be lifted in the future; its continuation gives rise to no compensation.

14. Governing law

These Terms of Sale are governed by French law. In the event of a dispute, an amicable solution will be sought before any action; failing that, the rules of jurisdiction protective of consumers apply.

15. Language

These Terms of Sale are written in French. Any translation, in particular into English, is provided for information only. In the event of any discrepancy in interpretation between the French version and a translation, the French version prevails and constitutes the only contractual text.
